These Terms of Service (“Terms”) govern your access to and use of goldwave.us and any purchase made from GOLD WAVE HAIR & CO LLC (referred to as “GOLDWAVE,” “we,” “us,” or “our”).
Throughout these Terms, “you” and “your” refer to any visitor, user, or customer accessing our store or Services. By browsing our site, creating an account, or placing an order, you agree to these Terms and all policies incorporated by reference. If you do not agree, please discontinue use of our Services immediately.

GOLDWAVE engineers high-performance grooming products designed for demanding hair types and real-world environments. We promise transparent formulas, honest guidance, and uncompromised quality. In return, we expect our customers to use our Services lawfully, provide accurate information, and respect our community, intellectual property, and operating guidelines.
3. Eligibility & Account Responsibility
• Age Requirement: You must be at least the legal age of majority in your jurisdiction to make a purchase. Individuals under the age of majority may only use our Services with the active involvement and consent of a parent or legal guardian.
• Account Integrity: If you create an account, you are responsible for maintaining the confidentiality of your login details and restricting unauthorized access to your device. You agree to accept responsibility for all activity occurring under your account.
• Termination Right: GOLDWAVE reserves the right to suspend or terminate accounts, refuse service, or cancel orders at our sole discretion in cases of suspected fraud, unauthorized resale, or policy abuse.
4. Cosmetic Intent & Individual Results
• Cosmetic Purpose Only: GOLDWAVE products are formulated strictly for cosmetic grooming. Statements on goldwave.us are for educational and styling purposes only. They do not constitute medical advice and are not intended to diagnose, treat, cure, or prevent any hair, scalp, or health condition.
• Performance Realities: Hair behavior is dictated by genetics, texture, density, porosity, moisture balance, climate, humidity, application technique, and styling routines. While our formulas are built to withstand heat and humidity, individual styling outcomes will vary. Descriptive terms such as strong hold, matte finish, or daily oil control reflect intended product attributes under test conditions, not an absolute guarantee for every individual.
5. Product Safety & Precautionary Guidelines
• Read all packaging, labels, and directions before application.
• Formulas are strictly for external use. Avoid contact with eyes. Do not ingest.
• Keep products out of reach of children and pets.
• Sensitivity Check: Review the full INCI ingredient list prior to use. If you have known allergies or sensitive skin, perform a patch test on your inner arm. Discontinue use immediately if irritation or discomfort occurs.

6. Orders, Pricing & Inventory Allocation
• Order Acceptance: Submitting an order constitutes an offer to purchase. An automated order confirmation email acknowledges receipt of your order; it does not constitute final acceptance. GOLDWAVE reserves the right to accept, limit, decline, or cancel any order for reason of inventory stock, pricing errors, shipping restrictions, suspected reseller activity, or payment verification issues.
• Pricing & Currency: All prices are displayed in USD. Applicable shipping charges, state taxes, and carrier fees are calculated and itemized at checkout.
• Price & Formula Adjustments: Product specifications, formulations, packaging, prices, and availability are subject to change without prior notice. In the event of an obvious pricing or typographical error, GOLDWAVE reserves the right to cancel affected orders and issue a full refund.
7. Payments, Promotions & Subscriptions
• Payment Processing: You represent that you are legally authorized to use your chosen payment method. Orders are processed via secure third-party payment gateways.
• Promotional Codes: Promotional offers, referral codes, and discounts:May not be combined unless explicitly stated;Cannot be applied retroactively to completed orders;Exclude gift cards, custom bundles, or sale items unless specified;Are limited to one redemption per customer/household where applicable.
• Subscriptions & Replenishment (When Active): If you enroll in a recurring order program, you authorize GOLDWAVE to charge your designated payment method on a recurring basis at the selected frequency until you cancel. You may modify or cancel your subscription through your account portal prior to the scheduled billing date.
8. Shipping, Delivery & Risk of Loss
• Address Accuracy: Customers are responsible for providing complete, accurate, and deliverable shipping addresses. GOLDWAVE is not liable for orders lost or delayed due to incorrect address submission.
• Carrier Delays & Force Majeure: Estimated delivery dates are carrier estimates, not guarantees. Delays resulting from weather, high holiday volume, customs holds, or supply chain disruptions outside our reasonable control do not constitute grounds for shipping refunds.
• Title & Risk: Risk of loss and title for items purchased pass to you upon delivery of the items to the carrier, subject to applicable state and federal laws.
9. Returns, Refunds & Third-Party Purchases
• Direct Purchases: Returns, replacements, and refunds for products bought directly on goldwave.us are governed exclusively by our published Returns & Refunds Policy.
• Retailer Purchases: GOLDWAVE cannot issue direct refunds or accept returns for products purchased through independent barbershops, wholesale partners, or third-party retailers. Please consult the original seller’s return policy. Quality or safety concerns regarding any GOLDWAVE product should still be flagged directly to aloha@goldwave.us.
10. Mobile Communications & SMS Terms
By opting into GOLDWAVE SMS/text marketing communications at checkout or via subscription forms:
• You consent to receive recurring automated marketing, order update, and promotional text messages at the mobile phone number provided.
• Consent is not a condition of purchase. Message and data rates may • You may opt out at any time by replying STOP to any text message. Reply HELP for support.
11. User Content, Reviews & Intellectual Property
• Brand Ownership: The GOLDWAVE name, logo, custom formulas, trade dress, product nomenclature, web graphics, photography, videos, and packaging designs are the exclusive intellectual property of GOLD WAVE HAIR & CO LLC and are protected under federal and international copyright, trademark, and trade secret laws.
• Customer Submissions: By submitting product reviews, user photos, video demonstrations, or testimonials to our site or official social channels, you grant GOLDWAVE a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and distribute that content across our marketing channels.
• Review Integrity: We welcome genuine customer feedback. We reserve the right to remove reviews that contain offensive language, unsubstantiated medical claims, personal personal data, or spam.
12. Disclaimer of Warranties & Limitation of Liability
• Service Availability: The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.
• Limitation of Liability: To the maximum extent permitted by law, GOLD WAVE HAIR & CO LLC, its officers, directors, employees, and suppliers shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of our site, products, or services. Our total aggregate liability for any claim arising out of or relating to a product purchase shall not exceed the net purchase price paid by you for that product.
13. Governing Law & Informal Dispute Resolution
• Governing Law: These Terms and any dispute arising from your interaction with GOLDWAVE shall be governed by and construed in accordance with the laws of the State of Hawaii and applicable United States federal law, without regard to conflict-of-law rules.
• Informal Resolution: Prior to initiating formal litigation, you agree to attempt to resolve any dispute informally by contacting aloha@goldwave.us with the subject line “Legal / Order Dispute,” providing a detailed statement of the issue and your desired resolution. Both parties agree to negotiate in good faith for a period of at least thirty (30) days before pursuing further legal remedies.

We may periodically update these Terms to reflect operational changes, legal requirements, or product additions. Updated versions will be posted on goldwave.us with a revised “Last Updated” date. Continued use of our site following such updates constitutes acceptance of the modified Terms.
